Welcome to AssessorIQ. These Terms of Use ("Terms") govern your access to and use of the AssessorIQ mobile application (the "App") provided by AssessorIQ ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account or using AssessorIQ, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you are using the App on behalf of an organization (such as a county, municipality, or assessment office), you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

AssessorIQ is a mobile-first platform designed for property assessors to capture, analyze, and digitize property data in the field. The App provides:

  • Mobile property assessment data capture
  • Photo and document upload and management
  • AI-powered data extraction from blue cards and assessment documents
  • Parcel map visualization with GIS integration
  • Structured reporting and submission management
  • Multi-jurisdiction support

The App uses artificial intelligence models to process your documents and extract property data. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. Account Registration and Security

3.1 Account Creation

To use the App, you must:

  • Provide a valid email address
  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Be a property assessment professional or otherwise authorized to access property assessment data
  • Comply with all applicable laws and regulations

3.2 Account Security

You are responsible for:

  • Maintaining the security of your email account used for authentication
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

Important: Never share your authentication credentials with others. Access to your account grants access to property assessment data and records.

4. Acceptable Use Policy

4.1 Permitted Use

You may use the App for lawful purposes consistent with these Terms, including:

  • Capturing and organizing property assessment data you are authorized to access
  • Processing blue cards and assessment documents for your jurisdiction
  • Generating reports for official assessment purposes
  • Managing property records across multiple jurisdictions you serve

4.2 Prohibited Activities

You agree NOT to:

  • Access or process property data you are not authorized to view
  • Use the App for any illegal, harmful, or fraudulent purpose
  • Attempt to gain unauthorized access to the App or its related systems
  • Transmit viruses, malware, or any other malicious code
  • Reverse engineer, decompile, or disassemble the App
  • Attempt to manipulate, exploit, or abuse the AI models
  • Use the App to create, distribute, or promote illegal content
  • Impersonate any person or entity or misrepresent your affiliation
  • Use automated scripts or bots to access the Service
  • Share assessment data in violation of any confidentiality requirements

Violation Notice: Violation of these prohibitions may result in immediate termination of your account and potential legal action.

5. Content and Intellectual Property

5.1 Your Content

You retain all rights to the property assessment data, photos, and documents you input into the App (your "Content"). By using the App, you grant us a limited license to:

  • Process your Content to extract data and organize records
  • Temporarily store your Content as necessary for service delivery

As stated in our Privacy Policy, your assessments are stored locally on your device and documents are not retained on our servers after processing.

5.2 AI-Extracted Data

Important: AI-extracted data is provided as a starting point and requires your professional review and verification. The App is designed to assist, not replace, professional judgment.

You are responsible for:

  • Reviewing and verifying all AI-extracted information before use
  • Confirming accuracy of property details, values, and assessments
  • Making final decisions on assessment determinations
  • Ensuring compliance with local assessment regulations and requirements

5.3 Our Intellectual Property

The App, including its design, code, features, AI models, and functionality, is owned by AssessorIQ and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. Key points include:

  • We only collect your email address for authentication
  • Assessments and property data are stored locally on your device
  • Documents are processed but not stored on our servers
  • Your data is not used for tracking or advertising

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Professional Advice

The App provides AI-assisted data extraction for general informational purposes only. It does not provide:

  • Professional appraisal or valuation advice
  • Legal advice regarding assessment regulations
  • Warranties regarding accuracy of extracted property data
  • Guarantees that assessments meet local requirements

Always have qualified professionals review assessment data before official use.

7.3 Accuracy of AI Extraction

The Assessor Stays in Control: While AI handles extraction and organization, you maintain full control and responsibility for the final assessment data. Always verify AI interpretations of documents and property information.

We do not guarantee:

  • The accuracy, completeness, or usefulness of extracted information
  • That the App will correctly interpret all document formats and notations
  • That the App will be error-free or uninterrupted
  • That all data from your documents will be detected

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASSESSORIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Errors or inaccuracies in AI-extracted data
  • Assessment errors arising from reliance on App-generated data
  • Any unauthorized access to or use of our servers
  • Any errors or omissions in any content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE LAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless AssessorIQ, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your use of AI-extracted data in official assessments
  • Your violation of any third-party rights, including intellectual property rights
  • Any property documents you submit through the App

9. Termination

9.1 Termination by You

You may stop using the App at any time and request deletion of your account by contacting us at joshjanzen@gmail.com.

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including if:

  • You violate these Terms
  • Your use of the App poses a security risk
  • You engage in fraudulent or illegal activities
  • We are required to do so by law

9.3 Effect of Termination

Upon termination:

  • Your right to use the App will immediately cease
  • We may delete your account data from our servers
  • Local data on your device will remain until you delete the App
  • Sections of these Terms that should survive termination will remain in effect

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify you through the App or via email
  • Give you an opportunity to review the changes

Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state where AssessorIQ is incorporated, without regard to conflict of law principles.

11.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through:

  1. Informal Resolution: First, contact us at joshjanzen@gmail.com to attempt to resolve the dispute informally
  2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association

You agree to waive your right to a jury trial and to participate in class actions.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AssessorIQ regarding the App.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

12.5 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
